I agree to indemnify, hold harmless, and defend the Released Parties from any loss, liability, damage, or cost they may incur due to my participation in Multilevel Basketball activities, whether online, in-person, or otherwise. This includes attorney's fees and any costs associated with legal proceedings.

I understand and willingly assume all risks associated with my participation in Multilevel Basketball activities, including but not limited to physical exertion, contact with other participants, slips and falls, equipment-related hazards, and the potential for contracting infectious diseases, including but not limited to COVID-19. I am aware of these risks and fully accept them, knowing that I may be injured or harmed.

I confirm that I am physically fit and have consulted a healthcare professional regarding my participation. I have no medical or physical conditions that would restrict or prevent my participation. If the participant is a minor, I certify that I am their legal guardian and consent to their participation.

I agree to disclose any pre-existing medical conditions that may affect my participation. I understand that failure to do so may result in increased risk and waive any liability arising from undisclosed conditions. I am responsible for any medical expenses incurred as a result of my participation.

In the event of an emergency, I consent to receive any medical treatment deemed necessary by emergency responders, physicians, or staff. I acknowledge that Multilevel Basketball is not responsible for any costs or expenses related to such medical care.

I acknowledge that Multilevel Basketball does not provide personal accident or health insurance. I am responsible for securing my own medical insurance to cover any injuries or illnesses incurred during participation. I confirm that I have adequate insurance coverage for any eventualities.

I grant Multilevel Basketball the right to take photographs or video footage of me during activities. I authorize the use of such media for any lawful purpose, including but not limited to publicity, illustration, advertising, and web content, without compensation or approval rights. I waive any right to inspect or approve the finished product or its use.

I agree to adhere to all rules, regulations, and safety procedures established by Multilevel Basketball to ensure the well-being of all participants and staff. I will follow all instructions provided by coaches and staff and adhere to any COVID-19 protocols in place. I understand that failure to comply may result in immediate removal from the program without refund.

I understand that cancellations must be made [X] days in advance to receive a refund. No refunds or rescheduling will be provided for cancellations made less than [X] days before the scheduled activity. Multilevel Basketball reserves the right to cancel or reschedule activities due to unforeseen circumstances, and I will be provided a full refund in such cases.

I acknowledge the risks associated with COVID-19 and agree to adhere to any safety measures implemented by Multilevel Basketball, including but not limited to wearing masks, social distancing, and disclosing any symptoms or exposure to the virus. I waive any claims related to COVID-19 exposure or infection.

This agreement is governed by the laws of the State of California. Any disputes arising out of this agreement will be resolved in the courts of San Diego County, California. I agree that any legal action or proceeding relating to this agreement shall be brought exclusively in the competent courts of California.

If any clause or provision set forth in this waiver is determined to be illegal, invalid, or unenforceable under present or future law, it shall be severable without affecting the enforceability of all remaining clauses or provisions. The remaining provisions will continue to be enforceable and remain in full force.

I have read this waiver of liability, fully understand its terms, and understand that I am relinquishing substantial rights by signing it. I acknowledge that I am signing this agreement freely and voluntarily and intend my signature to serve as confirmation of my complete and unconditional acceptance of the terms, conditions, and provisions set forth.

If the participant is a minor, I certify that I am the participant's parent or legal guardian and make these representations and provide my agreement to this waiver and release on the participant's behalf.
